The agreement
These terms are an agreement between your business (“you”) and legal entity name, ABN ABN (“we”, “us”), for the use of Worksted — the web application, the mobile app, and everything we provide with them.
By creating an account you accept these terms. If you are creating the account for a business, you confirm you are authorised to accept them on its behalf.
How we handle personal information is set out in our Privacy Policy, which forms part of this agreement.
Your account
- Worksted is intended for businesses operating in Australia. You must be at least 18 to hold an account.
- The person who signs up becomes the owner of the business account and can invite others and set what each of them can do.
- You are responsible for everything done under your account, and for keeping sign-in details secure. Tell us straight away if you think someone has got in who should not have.
- Give us accurate details, and keep them up to date — your invoices depend on them.
Trial, subscription and payment
The trial
New accounts get a 14-day trial with full access. We ask for a card at sign-up so the account is ready to keep running when the trial ends. You are not charged during the trial, and you can cancel at any point before it ends without paying anything.
Subscription
- Subscriptions are priced per seat, per month, in Australian dollars, and are charged in advance. Current prices are on our pricing page.
- A seat is a person who can sign in. Adding people during a billing period adjusts what you pay.
- Payment is taken automatically by our payment processor on each renewal date until you cancel.
- Plans include monthly allowances for some features, such as receipt scanning and document imports. Those allowances reset each billing period and are set out on the pricing page.
- We may change prices. We will give you at least price change notice period notice by email before a change affects you, and you can cancel before it takes effect.
If a payment fails
We will try again and let you know. If it keeps failing we may restrict access to the account until it is sorted out. Your data is not deleted — paying restores access.
Cancelling
You can cancel at any time from your billing settings. Access continues to the end of the period you have already paid for, and then stops. We do not refund part-used periods, except where the Australian Consumer Law requires it.
After cancellation we keep your data so you can come back — resubscribing restores everything. If you want it deleted instead, ask us and we will action it (see the Privacy Policy). We may delete the data of a cancelled account after post-cancellation retention period without further notice.
Your data
Everything you put into Worksted is yours. We do not claim ownership of your clients, jobs, quotes, invoices, photos or documents.
You give us permission to store, copy, transmit and process that data to the extent we need to in order to run the service for you — including sending it to the providers listed in the Privacy Policy. That permission ends when your account and its data do.
You are responsible for the data you put in: that you are entitled to hold it, that you have told your own customers what you need to tell them, and that it does not break the law.
You can export your records at any time while your account is active. Do that before you cancel, not after.
What you must not do
- Use the service to break the law, or to send anything misleading, abusive or unlawful to anyone.
- Upload malware, or anything designed to interfere with the service or other people using it.
- Try to get into parts of the system you are not entitled to, or into another business’s data.
- Resell or rebrand the service as your own, or share one seat between several people to avoid paying for seats.
- Put deliberate load on the service beyond normal business use, or scrape it automatically.
- Reverse engineer the software, except where the law says you may.
AI features
These features send the file you upload to a third-party AI provider outside Australia. What is sent, and how it is handled, is set out in the Privacy Policy. Receipt scanning is off unless your business switches it on.
Feature allowances apply, and we may change the underlying provider or model as better ones become available.
Availability and support
We work hard to keep the service running, but we do not promise it will be available without interruption. We may take it down for maintenance, and will give notice where we reasonably can.
There is no formal service level agreement. Support is by email at support@worksted.co during Australian business hours.
Worksted helps you produce documents that meet Australian tax invoice requirements, but it is not accounting, tax or legal advice. Your tax and compliance obligations remain yours.
Third-party services
If you connect an external service such as Xero, your use of it is governed by your agreement with that provider, not this one. We are not responsible for what a third-party service does, or for what happens if it changes or stops working.
Suspension and termination
- You can stop using the service and cancel at any time.
- We may suspend or close an account that breaches these terms, that has not paid, or that is being used in a way that puts the service or other customers at risk.
- Where the circumstances allow, we will tell you first and give you a chance to fix it.
- We may stop offering the service, giving you at least service discontinuation notice period notice and a refund of any period you have paid for but not used.
Australian Consumer Law and our liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Where we are permitted to limit our liability for a breach of a consumer guarantee, we limit it to resupplying the service or paying the cost of having it resupplied.
Subject to that, and to the extent the law allows:
- The service is provided as it is. We do not warrant that it will be uninterrupted or free of faults, or that it will meet every requirement you have.
- We are not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or anticipated savings.
- Our total liability arising out of this agreement in any 12-month period is limited to liability cap.
You keep your own records. Keeping a copy of information that matters to your business is your responsibility, not ours.
Changes to these terms
We may update these terms as the service changes. The version and effective date at the top of this page tell you which version applies. For a material change we will give account owners at least terms change notice period notice by email. Continuing to use the service after a change takes effect means you accept it; if you do not, cancel before then.
General
- If any part of these terms is unenforceable, the rest still applies.
- Not enforcing something straight away does not mean we have given up the right to enforce it.
- You may not transfer this agreement to someone else without our consent. We may transfer it if our business is sold or restructured.
- These terms, together with the Privacy Policy and our pricing page, are the whole agreement between us about the service.
This agreement is governed by the laws of governing state or territory, Australia, and both of us submit to the courts of that place.
